Kakalec Law Files Discrimination Complaint Alleging Persistent Sexual Harassment by McDonald’s Franchise Manager

NEW YORK, NY – Today, Daymari Negron Rosado, represented by Kakalec Law PLLC, sued MicDavis LLC and Giovanni Pillco in Manhattan federal district court, alleging she was subjected to constant sexual harassment during her time working at a McDonald’s restaurant in the Chelsea neighborhood of Manhattan. Ms. Negron, who was a crew member at the McDonald’s, seeks to hold the restaurant and the store manager responsible for the harassment, Giovanni Pillco, accountable for subjecting her to a hostile work environment and constructively terminating her because of her sex.

The lawsuit alleges that Pillco regularly made offensive sexual and personal comments to Ms. Negron, made unwelcome sexual advances from her, and touched her on the buttocks. After making the workplace intolerable for Ms. Negron and leaving her no option but to leave the job, Pillco tried to bribe Ms. Negron (using her personal banking information obtained through his position as store manager) to return to work and to be silent about the harassment.

Ms. Negron seeks to remedy the sex discrimination and sexual harassment she endured, bringing claims under Title VII of the Civil Rights Act of 1964 (as amended), the New York State Human Rights Law, and the New York City Human Rights Law against MicDavis LLC (the owner of the McDonald’s restaurant) and Pillco, the store manager of that McDonald’s.

The lawsuit alleges that the Colley Group LLC owns MicDavis LLC, which owns and operates the restaurant where Ms. Negron worked.

The lawsuit was filed in the U.S. District Court for the Southern District of New York. A copy of the lawsuit can be viewed here:
